Exemption from FUSF Charges

Customer certifies under penalty of perjury that it is exempt from FUSF charges because at least one of the following applies:

1. Customer is purchasing all services from ahoi for resale and incorporates these services into offerings subject to assessable U.S. telecommunications or VoIP services, with direct contributions to the federal universal service support mechanisms by the customer or another entity in the resale chain of services. 2. Customer uses the services exclusively for telecommunications or VoIP offerings that do not originate or terminate in the U.S., or serve non-U.S. customers exclusively.

Non-Exemption from FUSF Charges

Customer acknowledges that it does not qualify for exemption and may be assessed FUSF and applicable taxes by ahoi due to one or more of the following:

1. Customer purchases services from ahoi for direct use, not for resale. 2. Customer's FUSF contribution would be de minimis (less than $10,000 annually), or the customer is newly registered with the FCC for a Form 499 filer ID but has not yet begun contributing. 3. Customer is a systems integrator deriving less than 5% of its revenue from reselling services.
